1. Acceptance of Terms

By accessing or using The Feldenkrais Initiative, Inc. (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

The Feldenkrais Initiative, Inc. provides educational support for Feldenkrais Method practitioners. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

To access certain features, you may be required to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Upload harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to the Service
  • Use the Service to distribute spam or malware
  • Interfere with the operation of the Service

5. Intellectual Property

All content, features, and functionality of the Service are owned by The Feldenkrais Initiative, Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

6. User Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. If you have any questions regarding privacy, please read our privacy policy here.

8. SMS / Mobile Messaging Terms

By opting in to our SMS messaging program, you agree to the following terms in addition to these Terms of Service.

Program Description. You may opt in to receive automated SMS reminders about class attendance during in-person training segments, as well as related program updates from The Feldenkrais Initiative, Inc.

Message Frequency and Rates. Message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages only during your enrolled in-person training segments (typically 2–3 weeks each), with no more than 2 messages per day. You will not receive messages outside of these training segments. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Opt-Out Instructions. You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP,” we will send a confirmation that you have been unsubscribed and you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time.

Help and Support. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at help@feldenkraisinitiative.org.

Carrier Liability. Carriers are not liable for delayed or undelivered messages.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, The Feldenkrais Initiative, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless The Feldenkrais Initiative, Inc. from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
